The Central Government is looking to improve regulation for content being broadcasted through over-the-top (OTT) platforms, officials said, citing talks between the Ministry of Information and Broadcasting and the Ministry of Electronics and Information Technology over potential changes to the law.
The question currently being discussed is whether there should be a wetter law that gives clarity in the regulation of OTT content or a new law should be created.
Amendments to Existing Laws Under Consideration
The government is looking into two options, modifications to the Cinematograph Act, 1952 or adjustments to the Information Technology Act, said one official.
It follows a range of recent public statements calling for more regulation of the digital streaming content.
In the last six months, MIB has reportedly received a huge number of representations, more than 1,000 a month. These concerns cover issues such as obscenity and vulgarity with content across the Internet.
OTT Platforms Follow Different Rules
The issue has brought the matter of the differences between the regulation of theatrical releases and that of direct-to-DVD movies into the spotlight again.
The Central Board of Film Certification (CBFC) examines films meant for public presentation in the movie theaters, in pursuance of the provisions of Cinematograph Act. However, OTT content is not similarly subjected to any mandatory pre-certification and is mostly governed by provisions of the Information Technology Act and rules.
Government Examines Regulatory Framework
The government will look at strengthening the set up to tackle the complaints of the public and define the role of streaming platforms, officials said.
The talks include points of grievance redressal mechanisms and the level of government monitoring.
So far, though, it has not been determined if the legislature will enact changes or if another statutory program will be available.
Any modifications suggested will have ramifications for streaming services functioning in India, especially as it relates to content rational and complaint treatment and the requirements of regulators. Depending on the result of these results the next steps will be taken by the government.
