The District/ Sessions Court in Mapusa has turned down the bail petition of Saurabh and Gaurav Luthra, who will be the owners and operators of Goa nightclub Birch by Romeo Lane where a massive fire took the life of 25 people on the intervening night of December 6 and 7, 2025. On Thursday, District Judge Apurva Nagvenkar made the order in open court.
Luthra brothers had applied to be put under bail in relation to the Arpora nightclub tragedy which the authorities have alleged to have involved them with serious violations. In reaction to the court ruling, the defence counsel Parag Rao said that he would await receipt of a copy of the detailed order before making any decision on the next course of action. He pointed out that one of their strongest points was that they claimed that they did not apply the Section 105 of the Bharatiya Nyaya Sanhita (BNS) of culpable homicide not amounting to murder in the case.
Rao claimed that the defence would look at the way the court dealt with their submissions and look at the option of approaching the High Court upon consultation with their clients.
Conversely, the denial of bail was termed as a significant step towards justice by advocate Vishnu Joshi who was representing the families of the victims. He explained that the families are still determined to take the case to the end until those who did it face justice.
Luthra brothers had reportedly gone to Thailand soon after the tragedy. It was issued an Interpol notice and their passports were suspended after which they were returned to India and arrested. Since they were returned, they have been in judicial custody.
