The Supreme Court stayed, on Monday, the Delhi High Court order which had suspended the life term of former BJP MLA Kuldeep Singh Sengar and granted him bail in the Unnao rape case which has practically helped the criminals not to come out of jail.

A Bench led by Chief Justice of India Justice Surya Kant noted the curious circumstances of the case and noted that Sengar is convicted in various major offences. In pronouncing the order, the CJI said that the finding of the decision of the Delhi High Court of December 23, 2025, would remain stayed, and based on the order, the respondent would not be set free.

The highest court pointed out that the high court suspension of sentence and bail needed closer judicial examination especially since the offense is serious and the convicted party is serving a different related criminal offense. The intervention of Supreme Court keeps Sengar in custody as the case is further investigated.

Kuldeep Singh Sengar, a former state legislator of the Unnao district of Uttar Pradesh was convicted and sentenced to life imprisonment over the rape of a minor in a case that triggered national outcry and highlighted the problems of political influence and crimes against women. Intense public and legal scrutiny of the case had previously happened because of the allegations of intimidation, power abuse, and efforts to derail the investigation.

Sengar had been suspended in the sentence and bailed by the Delhi High Court and challenged this before the Supreme Court. With a sober approach to the issue, the highest court intervened in a matter of seconds in order to stop his release on grounds of the extraordinary situation of the conviction.

This stay put by the Supreme Court is being regarded as a major development in the case, which reaffirmed the judgment of the judiciary in regards to issues concerning crimes.
