On Tuesday, the Sultanpur court granted bail to Congress leader Rahul Gandhi in a 2018 defamation case filed by BJP’s Vijay Mishra. The case stemmed from remarks made by Gandhi against Home Minister Amit Shah. Rahul Gandhi, after surrendering in court, was briefly taken into custody for 30-45 minutes. His lawyer, Santosh Pandey, confirmed the bail application’s acceptance, with no future date set.
Advocate Pandey emphasized Gandhi’s innocence, denying any defamatory statements. He mentioned that if adequate evidence were found, Rahul Gandhi could face a maximum punishment of two years. The bail bonds were filed, and Judge Yogesh Yadav granted bail to Rahul Gandhi.
The defamation allegations arose from comments made by Gandhi during a Bengaluru press conference on May 8, 2018, where he reportedly made objectionable remarks against Amit Shah, who was the BJP president at the time. Gandhi criticized the BJP, highlighting the contradiction between the party’s claim of believing in honest politics and having a president accused in a murder case.
Vijay Mishra, who filed the complaint, expressed his distress over the accusations, citing his role as a party worker. He asserted that being associated with the BJP, he found it unjustifiable for Gandhi to label Amit Shah as a murderer, especially considering the BJP’s status as the country’s largest party.
Mishra revealed that he was the vice president of the BJP when the incident occurred and decided to file a complaint through his lawyer, leading to a five-year legal process. He emphasized the significance of defending the BJP’s reputation, stating that calling its president a murderer is unacceptable.
The defamation case against Rahul Gandhi reflects the complex dynamics of political discourse, with legal battles continuing over statements made during press conferences. As the legal proceedings unfold, the case underscores the importance of responsible communication and the consequences that political leaders may face for their public statements.
