In a move to pave the way for an amicable settlement between the two parties, the Supreme Court has sent the high-stakes cheque bounce case of actor Rajpal Yadav to mediation, alleging that the dispute that has involved about Rs 9 crore is pending for too long.
In the course of the hearing, Yadav’s plea disclosed that the outstanding amount of Rs 85 lakh was paid to court registry on October 13. The development follows the court’s order for the actor to pay the balance due part of the proceedings.
Asked by the Chief Justice of India how the parties could not settle their differences amicably. The case later went to mediation to give both sides a chance to see if they could reach a settlement.
In addition, the Supreme Court had asked the trial court to restore passport to Yadav. The actor had to go to Canada for an upcoming event, his advice to the court said. The engagement might be useful to him for financial prosperity and alleviate his economic problems.
The tussle has to do with seven cases regarding cheque bounce and associated with Murli Projects Private Limited. Yadav had been earlier convicted in these trials by the Delhi High Court and jailed for three months in each case.
In the earlier proceedings, the actor put up Rs 1.25 crore. The Supreme Court later ordered him to post another Rs 1.15 crore immediately with the remaining Rs 85 lakh by October 13 on the basis of the facts filed in the court.
Yadav’s lawyer has now told the court that the amount of Rs 85 lakh was paid. As the parties take steps towards mediation, the issue has reached the stage for them to explore the potential for settling the financial dispute.
The mediation process will be used to ascertain whether the two parties are able to come up with an agreement. An official referral does not imply resolution of the issue or that the previous conclusions have been overturned.
