New Delhi: The Supreme Court on Tuesday said that there will be no stay on the Election Commission’s proceedings to decide who commanded the “real” Shiv Sena Eknath Shinde or Uddhav Thackeray in Maharashtra. The decision is being seen as a big win for CM Eknath Shinde’s camp.
Hearing the petition regarding the rift in Maharashtra a Constitution bench of the Supreme Court headed by Justice DY Chandrachud pronounced the order in historical live streaming of the SC proceedings.
“We direct there shall be no stay on proceedings before the election commission. Interim application seeking stay stands dismissed,” the bench said.
The bench, also comprising Justices MR Shah, Krishna Murari, Hima Kohli and PS Narasimha, rejected the plea of the Uddhav faction that the poll panel not be allowed to proceed in the matter till the Supreme Court decides a plea pertaining to the disqualification of Shiv Sena MLAs.
The plea further contended that if the ECI is allowed to continue with the proceedings, it would not only precipitate issues of great Constitutional import, but would also cause irreparable injury to the applicant. It would also amount to interference with the judicial proceedings and thus, amount to contempt of court, stated the applicant.
