In a blow for the Cockroach Janata Party (CJP), whose leader is Abhijeet Dipke, the Delhi High Court has rejected a plea seeking restoration of the political party’s official X account.

A division bench headed by Justice Purushaindra Kumar Kaurav was unwilling to issue any ad-interim directions to revive the accounts. According to Justice Kaurav, a few posts by the account seemed to be “slightly offensive.” The court observed that the issue needed to be viewed from a holistic perspective and not through an emergency order. This implies that the formal orders will only be given after thoroughly hearing out the government and the social media network’s submission regarding this.

It was further reported that during the hearing, Justice Kaurav assured the lawyers representing the central government that their standpoint will be considered by the court while taking its final call.

Speaking on behalf of Abhijeet Dipke, senior counsel Akhil Sibal made an extremely forceful appeal for restoring the CJP’s account. As a compromise position, Sibal indicated that while he would not mind if his client’s offensive posts were blocked or deleted, he still wanted his main account to become operational once more. As part of his arguments in support, Sibal referred to several judicial precedents where interim relief was granted by the court to suspended accounts.

Nonetheless, the bench made it abundantly clear that this case was entirely different in this respect from other such cases that came before the court earlier. It explained that what distinguishes this case from all others is that in this instance the very content being discussed constitutes the problem. Thus, it noted, “There appears to be some difference in terms of the reasons for the past decisions and this case… The reason in this case, it appears, is the activity per se is somewhat offending.”
