New Delhi: This is because the Delhi High Court has taken a pioneering step towards curbing digital impersonation by granting an interim ex-parte order in the case of Indian businessman and Shark Tank India judge, Mr. Aman Gupta. The order directs the respondents not to misuse the identity of Mr. Gupta and uses his name, image, voice, and likeness, especially with respect to deepfakes and false endorsements.

The Court noted that prima facie there was sufficient proof in the case that there had been an infringement of the businessperson’s trademarks and personality rights. The interim injunction order directs the respondents not to misuse his persona for monetary gain by creating AI-generated content or selling merchandise and fake event booking portals under his name.

The most significant part about the order concerns the issue of deepfakes. The Delhi High Court has clearly issued the order to restrain the dissemination of morphed or manipulated content especially when such content includes sexually provocative videos or other misleading information that could potentially harm Mr. Gupta’s reputation.

Apart from the main accused, the High Court has ordered major intermediaries like Google to immediately delete/block any URL that enables such acts. Additionally, platforms have been asked to provide details about the users involved in these activities, which include their mobile numbers and email IDs.

Through this litigation, a number of other issues were brought to light, one of them being the use of Mr. Gupta’s slogans like “Hum Bhi Bana Lenge” and “Down, But Not Out.”
