New Delhi: In one of the most unusual legal dramas in India’s recent political history, Aam Aadmi Party convenor Arvind Kejriwal argued his own case in the Delhi High Court last week — not the excise policy case, as such, but his petition demanding that the judge hearing it step aside. Arvind Kejriwal appeared virtually before the judge via video conferencing as he urged her to take on record his rejoinder to the written submissions filed by the CBI.
During the hearing, Kejriwal told the court that he had been granted permission to file his rejoinder, but the registry was not accepting it, and it was not recorded in the order. He also stated that if his response was not taken on record, a “miscarriage of justice” could occur. The judge objected to this, stating that it was not appropriate to repeatedly state that a miscarriage of justice would occur. The court clarified that his affidavit had been taken on record, even outside the procedure, so such a comment was not necessary.
During the hearing, Justice Swaran Kanta Sharma reminded Kejriwal of court procedure and registry rules. She clarified that the registry was not accepting his petition because he was representing himself, and therefore, he was required to follow certain formalities as per procedure. The court stated that this was not an exceptional case and that the same rules apply to all litigants. The judge also clarified that proceedings must proceed only after prior permission, and that compliance with court orders is mandatory.
During the hearing, Justice Swaran Kanta Sharma stated that she was taking the arguments presented before the court on record as written submissions. She also noted that Kejriwal was being granted this exemption as part of due process, considering the allegations of bias leveled by him. The court was also informed that the verdict was originally scheduled for 2:30 pm, but given the affidavits and additional arguments in the case, the verdict time has now been extended to 4:30 pm.
