More than a month after a 25-year old biker was killed after falling into an open excavation pit on a public road in west Delhi, the Delhi Police arrested contractor Himanshu Gupta on Tuesday over the same. After a massive manhunt, the officials said Gupta was located in Udaipur, Rajasthan, and was then taken to Delhi to continue with questioning.

The accident happened during the night of February 5-6 when Kamal Dhyani a resident of Palam Village accidentally rode into a deep pit that had been dug as a part of sewer rehabilitation work in Janakpuri. The excavation was an undertaking of the Delhi Jal Board (DJB) which was repairing and upgrading sewer lines in the region. Dhyani was on his motorcycle when he fell in the pit and was fatally injured.

He was later rescued by the fire brigade staff who took him to the Deen Dayal Upadhyay Hospital. Doctors however pronounced him dead on arrival.

In the course of the inspection, the police discovered that the construction area did not have the necessary safety facilities. Police claimed that the excavation area did not have any barricades, warning signs, blinkers or proper lighting. Such measures are required by the project contract and traffic police guidelines as a precaution to the safety of commuters in roadwork.

The Delhi high court had previously denied anticipatory bail to Himanshu Gupta and Kavish Gupta, the contractors involved with the project. According to the court, the case was a preventable accident, with negligence and negligence in the exercise of safety measure causing a road that was otherwise safe to become a possible death trap. The case being investigated is still under progress.
