The April Visa Bulletin released by the US Department of State shows the Meteoric increase of immigrant numbers for ‘Final Action Dates’ and ‘Dates for Filing Applications.’ The dates these dates signify are the beginning of the time when applicants should prepare and submit their required documents to the National Visa Center.
As the April bulletin notes, the surge of demand for EB-5 Final Action Date unreserved visas from India, China, and worldwide Demand, has resulted in retrogression in Final Action Dates. This is because it ensures that the number of visas that are issued is constricted within the quotas already set for FY-2025.
The April 2025 Final Action Dates
EB-5 Unreserved Visa Categories:
China: January 22, 2014 (Retrogressed by over two and a half years)
India: November 1, 2019 (Retrogressed by more than two years)
All Other Countries: Current
EB-5 Set-Asides:
Rural, High Unemployment, and Infrastructure categories: Current for all countries
For applicants from China and India, the waiting times could be longer as their respective EB-5 Final Action Dates have moved back by more than two and a half years and more than two years respectively. It may also establish a Final Action Date for Rest of the World countries if demand continues to rise.
Also, India’s EB-2 Final Action Date will jump forward one month and China’s EB-2 will jump up more than 5 months. India and China Final Action Dates for the EB-3 will progress in two to three months, respectively. EB-2 Worldwide will at the same time move forward by five weeks and EB-3 Worldwide Professional/Skilled Workers category will pass one month.
Thus, since Congress has annual limits on immigrant visas, applicants must have an available visa both at the time of filing, as well as at the time of adjudication, and be able to transition to legal permanent residence. The retrogression shows the need for US residency and shows how our visa category limits affect applicants.
