Gwalior: Ever the leader of the opposition in the Madhya Pradesh Assembly, Dr Govind Singh, has not received any relief from the Supreme Court regarding the boundary demarcation of property in the Lahar case. The Supreme Court, in its ruling, declared non-admissibility of the petition and hence will not interfere in the matter. This case was defended by the senior advocate, Kapil Sibal, for Dr. Singh.
Thus, in disposing of the petition, the Supreme Court granted an enabling period of two weeks to file an appeal with regard to the orders of RI. This time, the court said, ‘Ministers and state administration do nothing. ’ After this period of time, if an appeal is not made, the administration is cleared to continue with their actions.
Dr Singh had confronted the administration’s written notice to dismiss him in both the Single and Division Benches of the High Court without granting any relief to him and thus has to turn to the Supreme Court. The local BJP leader, Babulal, alleged that Dr Singh had encroached upon the government land and had put up a house thereon. The complaint that Babulal filed stated that they had wished for a public entrance and exit and had turned it into the path of a house. Pursuant to the complaint, the Revenue Inspector served a notice to determine the boundary of the said property.
The Supreme Court ruling implies that the issue is now on the amount of time that Dr Singh will be allowed to appeal on the matter. Also, the administration shall be at liberty to take action upon the claimed encroachment if no appeal is made. This case shows that it is a continuous battle and litigation referring to the usage of the land and the existence of boundaries in the area.
