OBC Reservation: The way has been cleared for providing 27% reservation to OBCs in Madhya Pradesh. The Supreme Court has given the green signal to the decision of providing reservation by upholding the decision of the High Court. The state government’s decision to provide 27% reservation to OBCs was challenged in the Supreme Court. On Monday, the court settled the petition and upheld the decision of the High Court.
The Supreme Court heard the OBC reservation petition filed by Youth for Equality on Monday. While disposing of the petition filed by Youth for Equality, the court has made it clear in its order that there is no obstacle regarding OBC reservation.
After the petition was rejected by the Jabalpur High Court, all 75 petitions were transferred to the Supreme Court. Recently, the High Court had rejected the petition against OBC reservation, considering it irrational. The court had determined the formula of 87:13 through an important interim order in 2023 on this PIL filed in the year 2021.
The lawyer appearing on behalf of the petitioner in the court had told that according to the 2011 census, the population of OBCs in Madhya Pradesh is 50.9 percent, while the population of Scheduled Tribes is 21.14 percent and the population of the Muslim community is 3.7 percent. Despite this, the state government has provided only 14 percent reservation to the OBC category. While SC has been given 16 percent and ST has been given 20 percent reservation.
OBC Reservation Kamal Nath government had taken the decision
In Madhya Pradesh, the then Chief Minister Kamal Nath had increased the OBC reservation from 14 percent to 27 percent in the year 2018. Several petitions were filed in the Madhya Pradesh High Court to challenge this order of the government. Along with this, petitions were also filed in support of increasing the OBC reservation to 27 percent.
Apart from this, the Supreme Court has also taken a big decision in another case related to the Madhya Pradesh High Court. The Supreme Court Collegium has recommended the transfer of High Court Justice Arvind Dharmadhikari to the Kerala High Court. This decision was taken in the meetings of the Collegium held on 20 March, 24 March and 3 April 2025. The transfer was discussed in these meetings chaired by CJI Sanjiv Khanna.
