The Supreme Court of India on Tuesday allowed BRS Member of the Legislative Council K Kavitha to be released on bail in Delhi excise policy case. The decision came after the court raised concern about the investigation done by the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED).
K Kavitha, the daughter of the former Chief Minister of Telangana; K Chandrasekhar Rao, was arrested on March 15. The apex court Justices BR Gavai and KV Viswanathan heard the arguments put forward in the hearing by the CBI and ED and expressed doubts regarding the credibility of the testimonies against Kavitha. The court wanted to know as to what “material” the agencies had, to support the charges levied against Kavitha regarding her alleged involvement in the excise policy scam.
Kavitha’s counsel, senior advocate Mukul Rohatgi, urged the court for bail saying that both the CBI and ED investigating agencies investigations have been completed. He also referred to the decision made by the Supreme Court where it also allowed the AAP leader Manish Sisodia co-accused in this case to be granted bail.
In response, Additional Solicitor General SV Raju while representing the investigating agencies leveled the allegations that Kavitha had interfered with the proof by formating her mobile phone. Raju said that this action interfered with the probe. However, the legal team representing Kavitha countered this in a very blunt manner by terming it as fake or bogus, as they wanted to categorize it.
Bench grilling the agencies lawyer, the bench questioned: “What is the material to show that she was involved in the crime?” This question pointed to the fact that the bench was taking keen interest in the quality of evidence and procedural handling of the investigation going on.
This kind of CBI probe and the procedure of arresting innocent people are shocking and unbearable, that is why the Supreme Court granted bails to K Kavitha and other accused people also. The case has therefore received a lot of attention due to its sensitivity especially due to political influences.
