In the alleged Delhi liquor excise policy case, on Friday, the Delhi court asked Bharat Rashtra Saarthi (BRS) leader K Kavitha into CBI custody until April 15. The CBI, which is currently holding Kavitha in Tihar jail, which was the place where there were parallel financial crimes, has requested five days of custody remand. They are alleging that she was a major accomplice.

On April 6, the CBI had sought permission from Special Judge Kaveri Baweja on April 5 to question Kavitha while she was in judicial custody at Tihar Jail.

While court proceedings, advocates Vikram Chaudhary (as well as Nitesh Rana and Deepak Nagar) turned against the objection, saying that the agency’s evidence was old and lacked a connection with the arrest necessity. The petitioners focused on the claims that they were deprived of the due process of law and ascribed their illegal detention to a violation of Section 41 of the Code of Criminal Procedure (CrPC).

The timing of the arrest of Kavitha also was subjected to questioning, as she was the sitting MLC in Telangana and a crucial leader of a national-level political party that was going to have the Lok Sabha polls in the same state.

The court heard both arguments and allowed CBI to have Kavitha’s custody for three days, a time period between April 11 to April 15. Kavitha’s next appearance is scheduled for April 15 at 10 am.

All the events relating to the arrest of Kavitha took place on March 15, when she was taken into custody from her Hyderabad residence, and further judicial custody was enforced on March 26. The vocal leader of the protests is joining others such as former Deputy CM of Delhi Manish Sisodia, Rajya Sabha member Sanjay Singh, and Arvind Kejriwal, the Chief Minister of Delhi, who are facing charges in the same case.
