A court in Delhi ruled on Wednesday to release four accused in the 2020 conspiracy case in the Northeast Delhi riots, subject to the condition they met the bail conditions that were stipulated by the Supreme Court. Further Sessions Judge Sameer Bajpai fixed bail bonds at 2 lakh each, and two other local sureties of the same amounts, presented by Gulfisha Fatima, Meeran Haider, Shifa Ur Rehman and Mohd Saleem Khan, and gave them orders to be released on bail.
The orders were passed by the court after the Delhi police submitted verification reports which testified to the legitimacy of the sureties and documents introduced by the accused. According to the judge, everything that had been demanded by the apex court was complied and thus they were released under custody.
The fifth defendant who was bailed by the Supreme Court, Shadab Ahmad failed to appear before the trial court to post his bail bonds hence no order of release was granted to the defendant.
The documents and sureties provided by the accused had been checked by the trial court a day before, so the Delhi Police was delayed a little in order to confirm this. On Monday, the Supreme Court had provided bail to five of the accused in the case, and denied bail to the activists Umar Khalid and Sharjeel Imam, on the grounds of their alleged involvement in the case, and on the basis of a prima facie case of violation of the Unlawful Activities (Prevention) Act.
The supreme court had made it clear that all the accused were not in the same position and gave 11 strict terms to the people who were given bail. These encompassed posting of 2 lakh personal bonds, parting with of passports, no right to travel in and out of the National Capital Territory without the authorization of the court, compelled to tell his or her residential numbers, contact numbers and email IDs to the investigating officer and the court of trial.
