New Delhi- The Delhi High Court made this decision on Friday, specifically issuing a notice to the police who have asked for their response on the bail application of Bibhav Kumar, an offender related to the Chief Minister of Delhi, Arvind Kejriwal. Kumar was arrested over the allegations of Physical attack upon Aam Aadmi Party (AAP) Rajya Sabha MP- Swati Maliwal. A division bench of Justice Amit Sharma sitting in the vacation coram has directed the Delhi Police to submit its status report. The court has set a date for Summer recess on July 1 in the United States. This came after Kumar presented himself to the Delhi High Court on June 12 to seek his release on normal bail.

At present, in judicial custody, Bibhav Kumar did not receive bail by the Delhi court on 7th June. The court mentioned the congregation proceeding and the seriousness of the charges preferred against him and noted his potential threat to influencing witnesses. His previous bail plea was also dismissed on May 27 by a sessions court where the bench said there were solid reasons to believe Maliwal as there was no premeditation anywhere in her story.

Kumar was arrested on May 18 on charges framed based on a First Information Report (FIR) filed by Maliwal, alleging that Kumar had physically assaulted her at the Chief Minister’s residence on May 13. As per the information given in the FIR, Kumar used to beat Maliwal and assault her hands, and put his leg on her stomach and pelvis of Maliwal to kick her. For her complaint, the police filed an FIR against Kumar, which was categorized as sexual harassment, criminal intimidation, uttering words/gestures with intent to insult the modesty of a woman, and voluntarily causing hurt under the Indian Penal Code.

In the bail plea filed in the high court, Kumar contended that the lower court had not considered that he was no longer required to be in custody. In his petition, he contained that the investigating officer had concluded his investigation processes by compiling the necessary evidence and recording statements. “
