The Delhi High Court, while seeking ED’s clarification on Kavita’s plea for bail, inquires if the remaining part of her sentence can be served by her facing trial for a different case. BRS leader K Kavitha applied for bail in the court, accusing her of money laundering in the case of a trader’s conspiracy, which had allegedly caused huge losses in the liquor excise policy of 2021-22. Justice Sharma Swarana Kanta, during a recently held hearing, gave notice and scheduled the case for May 24th.

Kavitha’s appeal leaves doubt about her victimization by ruling party members and ED merely on the grounds of their allegations about her involvement in the excise policy scandal. She argues that the investigation is not performed professionally and politics play a key role. She filed a petition before the Delhi High Court seeking bail that was originally denied by the Sessions Court of which she materially questioned her ED arrest on March 15 and subsequent CBI custody. A bench of the lower court referred to a “prima facie” case of money laundering in the excised policy case.

Represented by senior advocate Vikram Chaudhary, Kavitha urged the court to expedite her case, citing the Supreme Court’s refusal of interim relief and instruction for prompt bail decisions. However, the ED, represented by special counsel Zoheb Hussain, requested time to respond to her application.

Challenging the trial court’s ruling, Kavitha claims the ED’s investigation is biased, relying on coerced statements. She alleges the agency is resorting to threats to extract false statements from witnesses to advance a political agenda.

Hearing out Kavita, we can only see the legitimacy of issues on ED’s actions and the fairness of its TBI. The speaker asks the judge to step in and argue that there were procedural violations and that this is a matter of violating legal protections. The case also showcases the intricacies of politicized trials where the fairness of the investigation coupled with safeguarding the rights of the individual are two key aspects worth exploring.
