The Dwarka District Court has taken a tough stand in the case of Kamal Dhyani’s death after falling into an open pit of the Delhi Jal Board in the Janakpuri area. In the hearing held on Friday, the court has rejected the regular bail plea of the accused sub-contractor Rajesh Prajapati. The court has directed the police to submit a status report every week until the charge sheet is filed, so that transparency is maintained in the investigation and the victim’s family can get justice. In order to provide justice to the victim’s family, the court has ordered that the case should be investigated under the supervision of a competent officer.

Judicial Magistrate H.S. Aujla, noting the gravity of the case, clarified that the loss of human life and the negligence in safety standards cannot be ignored. Furthermore, the Delhi Police has been directed to submit a mandatory status report of the investigation to the court every week until the charge sheet is filed. This will ensure transparency in the investigation and keep the aggrieved party informed of the case’s progress.
Refusing relief to subcontractor Rajesh Prajapati, the court stated that the loss of a 25-year-old man’s life is a serious matter that cannot be taken lightly. Prima facie, it found that serious negligence was committed in safety measures and supervision at the scene. The court believes that if the accused is released at this stage, he could influence workers, local residents, or other witnesses. Since the police are still gathering records and the investigation is in its initial stages, granting bail would not be appropriate.
