Oath Ceremony of Judges: With the swearing-in of 6 new judges in the Delhi High Court on Monday, the number of judges will exceed two-thirds of the total approved number. Currently, the sanctioned number of judges in the Delhi High Court is 60, which includes 41 judges including the Chief Justice. With this swearing-in, the collegium that appoints judges in the High Court will also change.
Justice Velluri Kameswara Rao, Justice Nitin Vasudev Sambre, Justice Vivek Chaudhary, Justice Anil Khetrapal, Justice Arun Monga and Justice Om Prakash Shukla will take oath. Justice Rao has now returned from the Karnataka High Court to his original Delhi High Court.
Who has been transferred?
Justice Sambre has been transferred from the Bombay High Court, Justice Chaudhary and Justice Shukla from the Punjab and Haryana High Court, and Justice Khetrapal from the Rajasthan High Court.
According to the data released by the High Court in June, the number of cases pending before various benches here is about 1.25 lakh. In recent months, there has been a sudden decrease in the number of judges in the Delhi High Court due to the retirement and transfer of some judges.
Reorganization of the Collegium
Justice Vibhu Bakhru, the senior-most judge of the Delhi High Court, was elevated as the Chief Justice of the Karnataka High Court on July 16. Due to this change, the three-member collegium of the Delhi High Court will also be reconstituted.
Till now, Justice Vibhu Bakhru and Justice Pratibha M Singh were included in the Collegium along with Chief Justice Devendra Kumar Upadhyay. But after the swearing-in ceremony on Monday, Justice Rao and Justice Sambre will also join the Collegium, as they are senior to Justice Pratibha M Singh.
The collegium system deals with the appointment and transfer of Supreme Court and High Court judges in the judicial structure of India. This system is not explicitly written in the Constitution but has evolved based on various decisions of the Supreme Court.
