The Chhattisgarh government is going to take a big step to provide relief to the common people. For this, the Chhattisgarh Public Trust Bill is being prepared for the monsoon session of the Assembly. Many things have been included in it, including the provision of abolishing the three-month sentence for illegally building a house, shop or complex and preparing to impose a fine of only 50 thousand rupees.
The draft of this bill, which will be presented in the monsoon session of the assembly, has been approved by the state cabinet. Under this, some changes are being made in the state’s Town and Village Investment, Excise, Chhattisgarh Society Registration Act and Chhattisgarh Industrial Act. There are preparations to impose a fine of Rs 5000 on those who drink alcohol in public places. Currently there is a provision of a fine of Rs 2000.
Sections 86 to 93 of the Industrial Relations Act deal with industrial dispute jurisdiction and others. These include notice of industrial disputes, conciliation procedure, constitution of tribunals and their jurisdiction, and other related aspects. In such cases, a provision can be made to deposit 50% of the maximum penalty amount.
Similarly, according to the subsection, this will not apply to the second offence after the verdict in the previous similar case. The authorised officer in subsection one can use his powers to close the case of such offence as per the direction of the state government. If a person does not follow the order of the responsible officer, then he will have to pay 20% of the maximum fine in addition to the fine.
Monsoon Session: There will also be changes in the Nagar-Village Investment Act
According to subsection 2 of section 69B of Nagar-Gram Nivesh Act 1973, there can be a punishment of three months or a fine of 50 thousand rupees or both for illegal construction of houses, complexes or other buildings. In the proposed scheme, a fine of fifty thousand rupees will be imposed. Subsection 4 of section 69 has a punishment of three months or a fine of five thousand rupees, while the upcoming amendment has a provision of a penalty of 25 thousand rupees.
Under subsection 2 of section 77, the Gram Panchayat will have to pay funds for the private toilet to the person running the toilet. If this is not done, there is a provision of punishment of three months imprisonment and a fine of five rupees or both. In this, a fine of Rs 25 thousand will be imposed on the guilty.
Heavy fine will be imposed for drinking alcohol in public place
Currently, under Section A of the Chhattisgarh Excise Act 1915, if someone opens a place for drinking alcohol without a license, or sells alcohol illegally, then there is a provision of a fine of less than Rs 5,000 and up to Rs 25,000. In the proposed amendment during the monsoon session, there is a provision of a minimum fine of Rs 5,000 for the first offense.
A fine of 2000 rupees is imposed for drinking alcohol at public places like schools, hospitals, places of worship, bus stands, railway stations and public roads. The proposed amendment will impose a fine of five thousand rupees. On the other hand, if someone illegally keeps, transports, manufactures, cultivates or stores alcohol, then there is a provision of a fine of 10 to 25 thousand rupees and 3 months imprisonment.
The fine for the first offence will be Rs 10,000 and for repeat offence the fine will be Rs 20,000. If a licensee or his employee violates any rule and does not provide certified documents, a fine of Rs 25,000 will be imposed on him.
