In a big turn of events, the High Court of Chhattisgarh has passed a contempt of court notice to lawyer Samson Samuel Masih over his allegedly objectionable statement against a serving judge of the high court. The advocate is noted by this division bench headed by Chief Justice Ramesh Sinha and Justice Vibhudutt Guru in a very serious way and directed him to slap his face, appearing before the court on July 18.
It was a case which arose during the proceedings in the case Shyamal Malik vs Mamta Das, where a judgement issued by the single bench of Justice Rakesh Mohan Pandey had been given a petition with much reasoning, and thus a case was filed against this. On the same day, though the operative part of the judgment was delivered, the petitioner was represented by senior lawyer Dr. Nirmal Shukla and the respondents were represented by advocate Varun Vats during final arguments. It had been observed by the court that this issue of jurisdiction of the family court was already taken and considered and rejected in a prior case (W.P. No. 227/31/2024) through an order dated April 8, 2024.
After the rejection of the petition, advocate Masih had issued a provocative remark in open court, stating that he knew that he could not get any justice in this bench. The above-stated was considered to be a contemptuous and derogatory statement towards the judiciary; therefore, it was reported and addressed to the Chief Justice. It was on July 10 that the subject was placed formally before the Chief Justice on the administrative side, where he directed the registry to act on it in accordance with the rules of the court by commencing contempt proceedings.
In the hearing, the division bench responded that a lawyer is answerable to his client as well as he has a duty as an officer of the court. Any derogatory remark directed towards the judge is an avenue to the dignity and decorum of the judicial system, and it is not at all tolerable.
