Raipur: The High Court in tenability, has quashed three different applications regarding compassionate appointment. The court also observed that basic requisites for granting of compassionate appointment include financial hardship or poverty of the family after the death of the breadwinner. The court also made it clear that there is no absolute arbitrary right to be given a compassionate appointment beyond the above-said basic parameters.
Among those, there was a case of the Ramadhar Tiwari family from Ratanpur. His widow applied for a compassionate appointment for his younger son named, Dinanath Tiwari, after the death of Ramadhar Tiwari on August 20, 2007, at the time of his service as an Assistant Sub-Inspector in the Police department. She filed two dack complaints at the office of Bilaspur Division of the Superintendent of Police in October and December 2007. Disputed with this, the family filed a petition in 2014 and got a refusal from the court after its consideration of all parties.
In another case, Yash Mishra from Baikunthpur was allowed employment under compassionate grounds after the death of his father. But Yash’s mother, Sunita Mishra, was a lecturer, and in 2018, the department snapped Yash’s services, claiming that his mother worked at a government job. Yash went on to approach the High Court, arguing that he was a student pursuing engineering in Bhilai at the time of the demise of his father; he had spent all his savings on the treatment of his father’s brain cancer. Nevertheless, the court dismissed his petition after the hearing of the case in question.
Likewise, Suman Sharma from the Kanker district is looking for a compassionate appointment as her father, Rammoorti Sharma, working as a Rural Health Organizer, expired in June 2019. Currently, she applied for the position in July 2019 at the Chief Medical and Health Officer’s office, Rajnandgaon. However, her application was rejected because her brother’s name was Raman Sharma he was already working as a Shikshakarmi Grade-I (Biology) teacher at the Govt. School, Kanker.
