Bilaspur: The Chhattisgarh High Court has recalled the stay order it passed in favour of Dr. K.K. Sahare, the former dean of the CIMS Bilaspur, and has dismissed his writ petition. The case has arisen out of an order from the Health Minister, Dr Shyam Bihari Jaiswal, who suspended Dr. Sahare for absence from the governing body meeting held at CIMS during the minister’s visit. Dr. Sahare had gone on the attack in the High Court seeking to overturn the suspension, but the High Court granted him a stay.
The government later objected to the stay for the matter, claiming that the investigations were in progress and no new changes required the stay to be kept. The High Court supported the said argument of the government and dismissed the stay and thus upheld the suspension order.
Dr. Sahare, through his counsel, submitted that he was not in a position to attend the meeting. He had alerted the medical education commissioner in a letter dated September 22, 2024, that he would be off work for three days because his brother had died. However, he received the suspension order from his lawyer companions and was informed by malice even though he had prior notice of the suspension. The counsel also argued that disciplinary action should not be taken, especially when the bus driver had various reasons that led to the blowing off of the demonstration horn. This had no merit in this case.
In response, the state government provided allegations against Dr Sahare- the embezzlement of funds under the Ayushman Bharat scheme, negligence, professional misconduct in the hospital ,including not regularly visiting hospital and negligence during surgeries. The government said that these allegations are still under investigation, which is why it would be incorrect to stop the process.
In rejecting the said petition, the court was not pleased with the unwillingness of the respondents in the course of the ongoing inquiry which should proceed uninterrupted.
