The matter of 27% reservation for OBCs in Madhya Pradesh is to be heard again in the Supreme Court today. A petition has also been filed in the Supreme Court by Congress leader Jaya Thakur regarding OBC reservation. It has been said in the petition that the interim order of Madhya Pradesh High Court in which 13 percent OBC reservation has been put on hold should be stayed or in the case of the High Court, the interim order should be cancelled. The government has filed a petition to transfer the case going on in Madhya Pradesh High Court to the Supreme Court, hence an important hearing on the matter is to be held in the Supreme Court today. After the decision of the Supreme Court, it will be decided whether this case will proceed in the Supreme Court or will continue in the Madhya Pradesh High Court as before.
Let us tell you that more than 60 petitions are pending in the High Court regarding giving 27% reservation to OBC category in Madhya Pradesh. In which some petitions are in favor of reservation for OBCs while some petitions are against giving 27% reservation. In the petition against OBC reservation, it has been said that by making OBC reservation 27 percent, the total reservation will exceed 50 percent, which will be against the order passed by the Constitutional Bench of the Supreme Court.
In fact, more than 60 petitions are filed in the High Court regarding the OBC reservation issue, on which several rounds of hearing have been held in the High Court. Meanwhile, the Madhya Pradesh government has filed a transfer application in the Supreme Court in which it has been said on behalf of the government that some petitions are already filed in the Supreme Court, hence the case going on in the Madhya Pradesh High Court will be transferred to the Supreme Court. Hearing should be held together, so that OBC category can get 27% reservation. This is the reason why the High Court is not hearing the transfer petition filed by the government in the Supreme Court. The High Court will not hear the transfer application until the Supreme Court clears its stand.
