The Supreme Court has bailed a YouTuber after under prosecution for making false comments against Tamil Nadu Chief Minister MK Stalin in 2021. Justices A. S. Oka and Ujjal Bhuyan, on the other hand, wondered about pre-election incarcerations considering their retaliatory character and indicating that there might be a wide spectrum of such occurrences.
Based on a tendency to investigate publicly released videos prior to elections, any indiscriminate arrests based on this might end up with a large number of individuals being charged. Sr. advocate Mukul Rohatgi, heavily on behalf of the state, knocked on the door of the court to consider imposing conditions on YouTube; as this would keep this person from making any further scandal while on bail.
While the judge raised the question challenging the court to decide who should declare which information would be offensive, he voted in favor of the appeal. However, even after being on the bail as a temporary measure for almost two and a half years, the court did not have any reasonable practical basis to cancel it. Subsequently, the Supreme Court quashed the order mandating the cancellation of bail and reinstated the previous bail order that had been promulgated earlier. The bench directed that nonailing of bail can be considered and granted when the need arises.
The YouTuber sought bail from the She High Court, which rescinded his earlier bail through an order. In his view, the Justice said that the undertaking which he had given in the court in the very next day that followed had been violated by him through his harsh comments against the CMO. The comments purportedly targeted to deter peace and tranquility from reigning the public land resulted in the grievance of the local DMK official and police report.
