Technology: Twitter has lost indemnity in India for failing to comply with the new IT rules on time.
A report suggests the microblogging site has “lost the coveted ‘safe harbour’ immunity in India over its failure to appoint statutory officers on the company’s role in India with the new IT rules.”
All social media giants were directed to comply with the new OTT lawsuit by May 25. However, Twitter failed to comply, citing the non-compliance “the microblogging site is now liable for penal actions against Indian Law as any publisher,” stated the government. Instead of being considered just a platform hosting content from various users, Twitter can now be held directly editorially responsible for posts published on its platform.
This comes hours after, an FIR was lodged against the microblogging site which accused the social media platform of not deleting tweets with regard to an incident involving a 72-year-old Muslim elderly man, Abdul Samad Saifi, being brutally thrashed in Ghaziabad’s Loni.
Twitter is charged with inciting communal sentiments with its posts about man’s allegation regarding the assault.
Responding to the development, a Twitter spokesperson on Wednesday said, “We are keeping the MeitY apprised of the progress at every step of the process. An interim Chief Compliance Officer has been retained and details will be shared with the Ministry directly soon. Twitter continues to make every effort to comply with the new Guidelines.”
