Upon Tuesday, the Supreme Court addressed the bail requests of Umar Khalid, Sharjeel Imam and others who are accused to be part of the supposed bigger conspiracy in the backdrop of the 2020 Delhi riots. Presenting the Delhi Police, Solicitor General Tushar Mehta and Additional Solicitor General SV Raju were also opposed to the bail applications in strong terms saying that the riots were not spontaneous but were well-planned and well-orchestrated.
The prosecution also argued that the accused has intentionally postponed the trial, and as such, the reason why they have spent being in jail almost five years does not necessarily entitle them to be put under bail. On October 30, the Delhi Police finally renewed its position by claiming that Khalid and his co-conspirators were hiding behind the anti-CAA rallies, which they termed anti-CAA rallies, which were sponsored and a radicalising agent that they used to gather communal violence throughout the nation. They accused that the end game of such activities was to undertake a regime change.
In the hearing, SG Mehta had argued before a bench of Justices that included Aravind Kumar and N.V. Anjaria that the account about the riots being spontaneous had to be rejected. And number one, such a myth must be debunked. This was not an out of the blue riot. It was a riot orchestrated, designed, and well constructed. That will come out of the evidences gathered and the gravity of the accusations made is very serious, Mehta said.
The case is due to go through another hearing session on November 20, during which the court should still be hearing the submissions presented by both parties. This is one of the high-profile cases, based on the violent confrontations that happened in North-East Delhi in February 2020, under the Unlawful Activities (Prevention) Act (UAPA).
The plea of bail of Khalid and Imam is pending as the court fight is still going on and the Supreme Court is likely to dig more into the facts and submissions.
