The Supreme Court on Monday served the actors Shreyas Talpade and Alok Nath putting them beyond any arrest in relation to an alleged marketing scam until the case investigation is over. It is a case of criminal breach of trust and cheating against the Human Welfare Credit Cooperative Society Ltd that has been accused of enticing investors.
In the hearing, a bench of Justices B V Nagarathna and R Mahadevan took into consideration pleas made by Talpade and Nath that sought the consolidation of several FIRs that had been registered in different states. According to counsel of Talpade, the actor had attended an annual event of the company as a guest celebrity and he was not paid anything. “I am not supposed to know. I never made any money, the lawyer said.
The lawyer of Alok Nath claimed that the actor was not present in any company event and he had been photographed in an advertisement more than ten years ago. The counsel also argued that the celebrities that present companies as brand ambassadors or to represent advertisements should not be personally liable to any litigation or monetary difficulties that the organization may encounter.
The Supreme Court court, conducting the hearing, stated that until the current investigation is over, both actors should be given the interim protection against arrest. The court said that we hereby overrule this writ petition by holding the interim order of protection of arrest already granted by us pending the investigation into the offences against the petitioner.
On January 22, under Sections 316, 318, and 318 of the Bharatiya Nyaya Sanhita, 2023, the FIR charges thirteen people, among them Talpede and Nath. As a victim, 37-year-old Vipul Antil of Sonipat, claimed that the actors had advertised the Human Welfare Credit Cooperative Society Ltd as brand ambassadors, which made victims invest.
