New Delhi: The Supreme Court has stayed the process of demolition of residential and commercial properties in Fatehpuri area of ​​Chandni Chowk, Delhi. A bench of Justice Suryakant and Justice N. Kotishwar Singh issued this order during the hearing on Tuesday, May 13.

The Supreme Court has issued a stern warning to the Municipal Corporation of Delhi (MCD) for failing to stop illegal constructions. According to sources, the court made it clear that if the MCD does not submit the status report on time, it will be considered as colluding with the builders.

Ban on demolition of residential buildings and commercial complexes

During the hearing, the court, taking into account the photographs of the area presented by the intervener, said that the MCD has not taken any steps to stop the illegal construction of commercial complexes. The Supreme Court gave clear instructions and said that in the meantime, the demolition of residential buildings and the construction and alteration of commercial complexes are stopped. The court also warned that if the report is not submitted, contempt proceedings will be initiated.

The advocate, while presenting on behalf of MCD in the court, said that after the court’s order, the area was inspected and a detailed report was prepared, but it could not be put on record due to holidays. The lawyer also informed that all illegal constructions have been removed from the area. However, the court refused to rely on the MCD report and underlined the need for independent inspection.

The court asked the petitioner to submit the names of independent architects and civil engineers so that they can inspect the site and prepare an unbiased report. The bench clarified that the MCD report cannot be trusted now, so independent inspection is required. The Supreme Court has set the next date of hearing of this case on May 23. Earlier, on February 17, the court had also considered the possibility of a CBI inquiry into this matter.
