Shiv Sena (UBT) senior leader Sanjay Lakhe Patil criticizes the parliamentary passage of the Waqf (Amendment) Act, 2025, since the legislation violates the “basic structure” doctrine established by the Supreme Court through the Kesavananda Bharati judgment of 1973. During the All India Muslim Personal Law Board’s Jalna unit event, Patil charged the BJP government of national rule for attempting to undermine constitutional practices while aiming to fuel political divisions.

According to Patil, the Waqf amendment breaks constitutional safeguards because it uses Article 368 procedures while eliminating the restrictions on changing the basic constitutional framework. The Kesavananda Bharati verdict gave the judiciary power to reject Constitution changes that would harm its core principles like secularism and federalism, according to his view.

The head of the Congress Party claimed the BJP works against national unity by focusing on minority groups instead of fostering ‘Ganga-Jamuni Tehzeeb’. Patil stated that Prime Minister Modi’s government provided financial advantages, together with “big packages,” to both Bihar Chief Minister Nitish Kumar and Andhra Pradesh Chief Minister Chandrababu Naidu as part of their alliance to win parliamentary support for the Bill.

The judicial review of this matter currently proceeds through court sessions where the highest Indian justice official has made strong objections. He strongly rebuked recent statements made by BJP MP Nishikant Dubey targeting the judiciary because they defied decent standards.

Shiv Sena (UBT) demonstrated its complete support for protesters against the Waqf Act by voting against the Bill in Parliament while continuing to defend constitutional values, according to Patil.
