The Supreme Court on Wednesday handed over the proceedings of the RG Kar Medical College trainee doctor rape and murder case to the Calcutta High Court and ordered it to monitor the execution of the previous orders of the apex court. A bench of Justices M.M. Sundresh and Satish Chandra Sharma directed all records of the cases to be sent to the High Court and that the copy of the latest status report also be given to the parents of the victim.
In 2024, the top court had assumed a su motu cognisance of the case after the case was met with a lot of outcry in the society due to the brutal crime. In the hearing, senior advocate Karuna Nundy, who represented associations representing junior and senior doctors, pointed out the fact that the Supreme Court had formed a National Task Force (NTF) after it realised that there was urgent need to form a national consensus on the safety and well-being of medical professionals. She filed that the task force had been established to propose tangible actions needed to overcome systemic challenges experienced by healthcare workers and that only another hearing would be adequate to end the case.
Concurring that the problem can now be adequately managed at the state level, the bench noted that a constitutional court in West Bengal was well-positioned to ensure that the proceedings are monitored. It asked the Chief Justice of the Calcutta High Court to refer the case to an appropriate division bench.
The case is connected to the rape and killing of one of the postgraduate trainee doctors whose body was located in a seminar room in RG Kar Medical College on August 9 last year. The following day a civic volunteer, Sanjay Roy, was arrested. On January 20, a Kolkata trial court sentenced him to a life imprisonment up to the death sentence. The case caused a wave of protests around the country and West Bengal in particular, as the doctors requested improved safety conditions.
