On Monday, the Supreme Court will listen to a petition derailed by Gitanjali J. Angmo, the wife of incarcerated climate activist Sonam Wangchuk challenging his detention over the National Security Act (NSA). Angmo has termed the detention process as illegal, unconstitutional and also unjust as it infringes his basic rights. A court that will consider the case will include Justices Aravind Kumar and N. V. Anjaria.

It previously stayed on November 24 following the request whereby Solicitor General Tushar Mehta representing the Centre and the Union Territory of Ladakh sought more time to respond to the rejoinder by Angmo. On October 29, before that, the Supreme Court had requested in-depth answers to both the Centre and the Ladakh administration of Angmo on his amended petition.

In her revised plea, Angmo states that the order of detention is based on old FIRs, unclear accusations and guesses, all of which are not directly or immediately linked to the reasons given invoking NSA. She argues that the order is not legally and factually justified, and is an arbitrage and irrational application of the preventive detention authority that compromises constitutional freedoms and due process.

The plea also cites that it is absurd and unimaginable how Wangchuk, who has earned international acclaim throughout the past three decades as the founder of grassroots education, sustainable technology, and environmental protection, would be considered suddenly as a menace to the national security. She further explained that violent events that took place in Leh on September 24 cannot in any way be blamed on the actions or the speeches of Wangchuk.

Angmo reported that Sonam Wangchuk was publicly denounced the violence, saying that such events endanger the years-long successful quest of Ladakh to statehood and protection under the Sixth Schedule. He even termed the day of violence as being among the saddest days of his life.
