The Supreme Court has ordered advocate Prashant Bhushan to furnish evidence that supports the allegation of violating a bail condition provided to Ashish Mishra, who is the son of Union Home Minister Ajay Mishra, for the festival of Lakhimpur Kheri violence in October 2021.

It appears that Ashish Mishra supplied tricycles at a program in Uttar Pradesh – sentence starts with an introductory phrase- despite the court’s restriction, which only permits him to attend trial proceedings in the state. The court, hearing his bail petition in January 2023, granted a conditional bail subject to the condition of putting him under surveillance. Again, the court extended the bail on later occasions.

The Bench comprising Justices Surya Kant and PS Narasimha dwelt on venturing outside while on bail. Such a situation can raise doubts about the authenticity of the order itself. The attorney, who came to be known as Advocate Bhushan, representing the bereaved families, was given the chance to present respected evidence.

The defendant stated that he was surprised about the fact that the candidate for the driver’s seat was Ashish Mishra. He stated his intention to submit an affidavit and say that the court rules were infringed by the use of the video evidence. Courts, without immediate instructions, granted Bhushan the opportunity to file an affidavit.

Lead counsel of the accused, Siddharth Dave, argued that his client respected the reputation he had earned and would not act so callously that it would result in him being brought to justice. He knocked down the Danish video evidence using the same example that the language of a person and the language of the documentary are different and should never fall into the same category.

To cut the time scale of the supreme trial, the Supreme Court prescribed frequent progress follow-ups and granted interim bail in the Lakhimpur Kheri violence case of Ashish Mishra as well. The March 20 court report for the latest trial testified about abandoned witness marks and influenced the Supreme Court to pay heed to the local police and the public prosecutor to take responsible actions to ensure the attendance of witnesses. The court granted judicial registry in the Supreme Court to be the submitter of the Trial judge’s report to Uttar Pradesh’s additional advocate-general, Garima Parsad, for taking action.
