The petition seeking the displacement of Allahabad High Court judge Justice Yashwant Varma never received a formal admission in the Rajya Sabha because it was deemed faulty taking a new twist onto the case that has rocked the Supreme Court in relation to the suggested removal of the judge.
A petition presented by Justice Varma is being heard by the Supreme Court and, in the case, he has questioned why the Lok Sabha Speaker proceeded to initiate the impeachment proceedings on its own, despite the fact that a similar request had also been filed in the Rajya Sabha. This has been challenged by the fact that it was impossible to have parallel proceedings in both Houses at the same time. On December 16, the highest court had invited both the responses of the Lok Sabha and the Rajya Sabha after noting that the petition had a valid legal issue at prima facie.
The office of the Lok Sabha Speaker in its rebuttal explained that just after the motion was introduced in the Rajya Sabha, an official communication was forwarded to the Lok Sabha that the motion had been found to be defective and was not passed. On this basis, it was on August 11 that the Lok sabha Speaker admitted the motion and proceeded with the proceedings under the Judges (Inquiry) Act, 1968.
A committee to investigate the charges brought against Justice Varma was then established. Supreme Court justice Aravind Kumar heads the panel which was constituted in the statutory procedure that is imposed in such cases.
The reply also added that by the time the Rajya Sabha Chairman had reported to the House about receiving the motion, no formal scrutiny of the same had been undertaken and no decision on the admissibility of the same had been taken.
