Greta toolkit case: Maharashtra-based Engineer issued an interim bail

Mumbai: After the arrest of Disha Ravi; the 2 accused activists Shantanu Muluk’s plea and Nikita Jacob’s plea heard.

After presenting a plea in the Aurangabad bench of Bombay HC; Justice Vibha Kankanwadi granted a 10 days’ transit anticipatory bail, to enable him to apply for protection before the appropriate court in Delhi.

During the hearing. Justice Vibha said, ” Apprehension of arrest is the key factor that is required to be considered in such applications.” 

On an objection from the advocate representing Maharashtra, advocate Satej presenting Muluk argued that he only needs time to approach the Delhi court since a team of Delhi police was already in Beed.

The court noted that Shantanu Muluk has “given reasons as to why he is apprehending his arrest and that is sufficient. The FIR is lodged at New Delhi and any regular application for anticipatory bail under Section 438 of the Code of Criminal Procedure would be considered by Delhi High Court, and therefore, this Court cannot go into any of the merits of the case. The only fact that is required to be considered as to whether the applicant can be granted liberty by way of transit bail to approach to the competent authority for seeking appropriate relief.” 

In the event of the arrest warrant issued against Muluk; the court had ordered him to furnish a personal bond in the sum of Rs50,000 for bail.

On the other hand, the HC heard advocate Nikita Jacobs’s bail plea in connection with the same case but reserved its order. 

Both the accused had approached the Bombay HC seeking anticipatory bail in the “toolkit case”. Their names were revealed during the interrogation of environmental activist Disha Ravi who was arrested from Bengaluru earlier this week.
