The Delhi HC on Monday issued a notice to the “Twitter” for its purported non-compliance to the IT Lawsuit 2021. The bench of Justice Rekha Palli gave Twitter three weeks to reply and posted the matter for hearing on July 6.
The court was hearing the petition filed by Advocate Amit Acharya arguing that micro-blogging site must perform legit “significant social media intermediary” as per the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
Senior advocate Sajan Poovaya appearing for Twitter told the court that a resident grievance officer had been appointed on May 28. The government’s counsel Ripudaman Bhardwaj opposed this stand. The petitioner told the court that he came to know of Twitter’s non-compliance when he went to lodge a complaint against some tweets.
On May 25, Twitter released a statement affirming it will strive to comply with the new rules. It additionally stated to advocate for changes to elements of these regulations that inhibit free, open public conversation. Taking strong objection against the statement, MeitY accused Twitter of “levelling baseless and false allegations to defame India and dictating terms to the world’s largest democracy.”
As per the new guidelines, companies like Twitter, WhatsApp, Facebook, and Google were to regulate their content, appoint grievance officers who will be liable for compliance, and adopt measures like tracing of individual messages and voluntary user verification.
