New Delhi: On the last working day of DY Chandrachud as the Chief Justice of India, Justice Chandrachud acknowledged on Friday that he would no longer serve as the country’s top judge, and said, “I won’t be able to deliver justice from tomorrow, but I am content”. In his final address in the court, Justice Chandrachud sought forgiveness in case he “ever hurt anyone”.
DY Chandrachud will demit office on Sunday, November 10. He will be succeeded by Justice Sanjiv Khanna as the 51st CJI on November 11. Speaking at the convocation ceremony of the JSW Law School in Bhutan, the Chief Justice said, “As my tenure is coming to an end, my mind has been heavily preoccupied with fears and anxieties about the future and the past.”
DY Chandrachud shall be prohibited from practicing law in any Indian Court. The Chief Justice and other Supreme Court judges are prohibited from practicing law in any Indian court, after their term ends, according to the Article 124(7) of the Constitution. “No person who has held office as a Judge of the Supreme Court shall plead or act in any court or before any authority within the territory of India”.
The rationale behind this restriction is to maintain the integrity and impartiality of the judiciary. Allowing a former CJI or any Supreme Court judge to practice law could create situations where their previous judgments could be perceived as having an undue impact on the judicial process.
