A notice of a substantive motion in the Lok Sabha against Leader of Opposition Rahul Gandhi was given by BJP MP Nishikant Dubey, which could in effect result into him being expelled by majority vote. Dubey has referred in his notice to a parliamentary investigation of what he termed the habitual misconducts of Gandhi to destabilize the country, and has requested the Congress leader to be not only expelled as an MP, but also disqualified to contest any more elections in his lifetime.
Dubey accused Gandhi that he was a member of the so-called thuggery gang, that was trying to undermine India internally. He particularly protested against the statements contained in the current Budget Session of Parliament when the Congress leader himself, Gandhi, made references to an unpublished manuscript of the former Army Chief General M.M. Naravane. Gandhi had alleged that the book reveals the alleged lack of responsibility by the Prime Minister Narendra Modi in the border tensions with China in 2020.
BJP MP Dubey suggests that Gandhi used the reference to the manuscript with a malicious intent of damaging the Indian Army, the Ministry of Defense, and the Prime Minister. The book was called Four Stars of Destiny, and has been awaiting Defence Ministry approval since 2023. Gandhi had even shown a printed copy to the House, and a lawsuit was filed against the dissemination of the PDF version on the Internet.
As per Article 105 of the Constitution and rules of parliament, the Lok Sabha can expel members in case of grave misconduct. The use of substantive motions has been previously been applied to high-profile cases, such as in the 2005 cash-for-Questions scandal and in the 2023 expulsion of TMC MP Mahua Moitra.
