Mumbai– On Tuesday, the Bombay High Court passed a judgment on releasing the Juvenile accused in an observation home. Police said the accused, a 17-year-old boy, was allegedly driving a Porsche with alcohol and hit the two software engineers who were riding a motorbike in Kalyani Nagar, Pune, on May 19 early in the morning. The court’s ruling said: “We admit the petition and grant the discharge order. The respondent CCL is to be in the care and custody of the petitioner (paternal aunt). ”
The High Court bench submitted the remand orders passed by the Juvenile Justice Board (JJB) as unlawful and being passed without authority. First, the JJB released the teenager, who is the son of the real estate developer Vishal Agarwal, on the terms of writing at least a 300-word essay. Such a decision caused a lot of uproar from the citizens. The police reacted to the backlash by seeking a review from the JJB, which ordered that the boy be placed in an observation home. The authorities are now planning to transfer the minor for an adult trial and thus face complicated prosecution charges.
Police managed to get the CCTV footage whereby the teenager was seen taking alcohol in a pub before the accident. Pune Police Commissioner corroborated the antics of the rather embarrassing video, stating that the boy understood what he was doing. Apart from the arrest of the teenager, his father, Vishal Agarwal, was also arrested for endangering the life of a child. Policemen also arrested two bar owners and an employee for selling alcohol to a teenager.
The High Court stressed that the Juvenile Justice Board overlooked CCL’s age, suggesting, “The CCL’s age was not considered. The CCL is below 18 years and requires consideration. It is to be noted that CCLs require a different treatment. Further, the rationale behind the Juvenile Justice System is rehabilitation. ” They observed that the accused is currently in rehabilitation and being attended to by a psychologist, which shall remain the case.
