By rejecting his petition appealing against a decision of the MP/MLA Special Court in Varanasi, the Allahabad High Court has given a big blow to Congress leader Rahul Gandhi. The discussed order refers to the statement by Gandhi in his visit to the United States in 2024, when he expressed himself on the religious freedom of Sikhs in India. The statements were considered highly controversial by many and had brought both local and foreign eyes to the political scene.
Rahul Gandhi had also appealed in the high court of Allahabad to have the decision of the Varanasi special court overturned, that a petition against him. The high court, however, denied the plea, which in effect allowed the case to be carried on in the MP/MLA Special Court at Varanasi. The decision means that the legal action regarding the comments made by Gandhi in foreign countries will be pursued, and he will now be answerable in the relevant court to the petition.
The case here revolves around the statement of Gandhi in the US, where he seemed to indicate that the Sikhs in India are not allowed to exercise their religion freely. Gandhi had once remarked, “Whether he, being a Sikh, should be permitted to wear a turban in India; or whether he, being a Sikh, should be permitted to wear a kada in India; or whether he, being a Sikh, should be permitted to attend a Gurudwara. That’s what the fight is about.” All these remarks were criticised by different political quarters, with the opponents arguing that he was misrepresenting the picture of religious freedoms in India.
The Allahabad High Court ruling to deny the petition of Gandhi is critical in highlighting the judiciary to proceed with the legal course of action, despite the political nature of the matter.
