New Delhi: Petitions challenging the constitutionality of the Waqf (Amendment) Act, 2025 have been listed for hearing on April 16, 2025. The first hearing on Waqf Law will be held by a bench of 3 judges headed by Chief Justice Sanjiv Khanna. Justice Sanjay Kumar and Justice KV Vishwanathan are the other 2 bench members. The case is listed number 13 for hearing. The court will begin with the petition of Hyderabad MP and AIMIM leader Asaduddin Owaisi will be heard.

“In exercise of the powers conferred by sub-section (2) of Section 1 of the Waqf (Amendment) Act, 2025 (14 of 2025), the Central government hereby appoints the 8th day of April, 2025 as the date on which the provisions of the said Act shall come into force,” the Ministry of Minority Affairs notification has said.

So far 20 petitions have been filed in the Supreme Court against the Waqf Amendment Act. In all the petitions, it has been mainly said that this is a law that discriminates against Muslims. Waqf is a religious institution. Government interference in its functioning is wrong.

Leaders of political parties like Congress, RJD, SP, DMK, AIMIM and AAP, besides Jamiat Ulema-e-Hind President Arshad Madani and All India Muslim Personal Law Board have filed 20 petitions against the Waqf Amendment Act so far. The main contention in all the petitions is that this is a law that discriminates against Muslims.

The petitioners have said that the new Waqf law is against fundamental rights like Articles 14, 15 (equality), 25 (religious freedom), 26 (management of religious affairs) and 29 (minority rights) of the Constitution. The petitioners have also said that the change in the law is against Article 300A i.e. the right to property.
