The Supreme Court has honorably released the murder accused after 21 years. The court admitted that it was too late to get justice for the accused. Most importantly, the accused’s case was pending in the Supreme Court for only 13 years, then the verdict was reserved for 11 months. In August 2003, Mohammad Bani Alam Majid was arrested for murder and kidnapping of a 16-year-old minor and in 2007, the Kamrup Sessions Court sentenced him to life imprisonment.
The Guwahati High Court also upheld the decision of the Sessions Court in 2010. In 2011, Majid appealed to the Supreme Court, which was heard for the first time in August 2011. The Supreme Court said that the bail plea would be renewed after two years. His bail plea was rejected in 2017. In October 2018, he got interim bail for eight weeks, which was given to meet his ailing mother, but had to return to jail again.
It took the Supreme Court 10 years to decide on this case. The debate ended on 21 March 2024 and the decision was reserved. On 24 February 2025, a bench of Justices Abhay S Oka and Ujjwal Bhuyan decided that no charges could be proved against the accused, so he would be honorably acquitted.
While giving the verdict, the bench said that Majid and the victim were married and their families were assured of marriage, so sexual assault could not have happened for money. The bench also said that there was a long time gap between the last time the victim was seen and the time her body was found, so there was not enough evidence against the accused.
According to the National Judicial Data Grid, more than 81 thousand cases are pending in the Supreme Court, out of which only 55% criminal cases are pending for more than a year.
