The verdict of the Madhya Pradesh High Court in the high-profile defection case of Bina MLA Nirmala Sapre, who was elected to the assembly on a Congress ticket but later alleged to have defected to Bharatiya Janata Party (BJP), has been put on hold by the court.

The court solicited the sequences of arguments from both the petitioner and the respondent parties and eventually closed the proceedings and took time to pass a final judgment. This case has raised a lot of political interest as its verdict could impact party loyalty and anti-defection laws in the state.

Attorneys on both sides made their cases and evidence in the hearing before the court. The bench considered the petition and other documents, and decided it would consider the petition later.

The High Court had earlier asked about the delay in acquiring resolution over the issue, asking why the matter had not been resolved in the Assembly even after almost two years since it was pending. The case had been pending before the Assembly Speaker, and the state’s Advocate General told the court at that time.

A major development in the case was when Sapre reportedly told court that she remains a member of the Congress. The statement was taken down as part of a court proceeding.

The issue started after Congress candidate Sapre managed to defeat BJP candidate in Madhya Pradesh Assembly elections in 2023 bidding for Bina as its candidate. Opposition leaders accused her of openly supporting BJP candidates and being involved in BJP activities during the Lok Sabha election campaign in 2024.

Later, anti-defection leader Umang Singhar had sought disqualification on the above breach of the anti-defection rules. Now that arguments have been made, the eyes of everyone are now on the High Court’s ruling.
