Mumbai: In an important decision concerning the functioning of sports administration in India, the Central Information Commission (CIC) has ruled that the Board of Control for Cricket in India (BCCI) does not come within the ambit of the Right to Information (RTI) Act. The transparency body made it clear that the richest sports organization in the country cannot be considered as a ‘public authority’ under the transparency statute.
This judgment will certainly come as a huge sigh of relief for BCCI as it was continuously trying to avoid being brought under the scanner of transparency through the RTI law. As per Section 2(h) of the RTI Act, any entity would be treated as a public authority if it is established by or under the Constitution, by a law made by Parliament or state legislatures, or if it is substantially financed by the Government.
However, the CIC found that none of these conditions were fulfilled by BCCI. It has neither been constituted by any particular statute nor does it get substantial financial support from the Government for managing its activities including running cricket tournaments both domestically and internationally.
The ruling stems from a case where information regarding the board’s internal decisions and financial dealings was sought under the transparency Act. By establishing that the BCCI operates as an autonomous private body registered under the Tamil Nadu Societies Registration Act, the Commission reinforced that the board is immune to direct public mandates meant for government institutions.
While the verdict offers the BCCI administrative autonomy, it reignites the long-standing debate among sports enthusiasts and legal experts over transparency in Indian sports administration. Detractors argue that given the BCCI’s massive public influence and its role in representing the nation globally, it should be subject to public accountability, whereas proponents maintain that financial independence justifies its private status.
