On Thursday, the Supreme Court of India declined its bail cancellation order on an accused involved in a murder case of Baba Siddique supporting the previous decision of the Bombay High Court. The Supreme Court rejected a plea made by the widow of the deceased leader, Shehzeen Ziauddin Siddique, who sought the bail of a suspected Akashdeep Karaj Singh.
Justices JB Pardiwala and KV Viswanathan made the observation that the decision of the high court was well-grounded and founded on a thorough review of the evidence presented. The judges also pointed out that criminal cases need to be judged on case to case basis and they should not generalise all accused people without proper evidence of their involvement.
In the course of the hearing, the counsel of the petitioner tried to associate Singh with a criminal gang that was supposed to have committed the murder. Nevertheless, the court observed that the high court had already determined that such claims were analyzed and that there are not enough facts to prove the existence of prima facie guilt. The bench also commented that the appeal did not have good legal grounds to warrant the rejection of the bail order.
The government of Maharashtra also showed an interest in appealing the bail independently, making the court wonder why it took the form of the delay.
The case is related to the murder of Baba Siddique, a high-rank political figure, who was shot dead in October 2024 in Mumbai. Singh was later arrested at Punjab, aged 22 and was the first accused in the case who managed to make bail which was a great development in the ongoing investigation.
