Rajasthan News: The Rajasthan High Court has issued a stern verdict regarding irregularities in medical education. Ten private dental colleges in the state have been fined a whopping ₹10 crore each for flouting BDS admission rules. The division bench of Justice Vijay Bishnoi and Justice J.K. Maheshwari clearly stated that such negligence has weakened the standards of medical education, which is intolerable.
The court also raised serious questions about the role of the state government. It ordered the government to deposit ₹10 lakh with the Rajasthan State Legal Services Authority (RSLSA) for failing to follow the legal process during BDS admissions for the 2016-17 academic year.
During the hearing, it emerged that the state government, without legal permission, had granted a 10 percent and an additional 5 percent relaxation from the minimum NEET qualifying percentage. This decision allowed many students who did not meet the eligibility standards set by the Dental Council of India to gain admission to dental colleges.
However, in a December 18 decision, the court granted relief to students who had secured admission based on the NEET percentile relaxation in the 2016-17 academic year, citing special circumstances. Using its plenary powers under Article 143 of the Constitution, the High Court ordered the regularization of their BDS degrees.
Advocate Rishabh Sancheti, appearing for 59 students in the main petition, said the apex court has directed these students to file an affidavit in the Rajasthan High Court, undertaking that they will provide free services in case of any disaster, epidemic or emergency, if called upon by the state government.
The court clarified that the colleges in question had directly violated the 2007 regulations. Admissions were granted beyond the prescribed limits, which is against the law. The High Court also reprimanded the state government, stating that granting such exemptions without authority and failing to timely inform the central government and the Dental Council of India constituted a serious lapse.
