On December 22, Chief Justice of India Surya Kant will sit on a special vacation bench of the Supreme Court to hear urgent cases that may require urgent judicial hearing during the holiday of the court. The shift has been taken to make sure that pressing issues will not be postponed because of the current holiday season of Christmas and the New Year.
According to the cause list that has been uploaded on the official site of the Supreme Court, the special vacation bench will consist of CJI Surya Kant and Justice Joymalya Bagchi. The bench would sit at 11 am and should consider 17 urgent cases, both criminal and civil.
The apex court made an official statement saying that the Chief Justice has formed the special vacation bench in order to deal with urgent cases in the court during the court vacation. The court explained that the scheme is meant to ensure that there is relief ASAP in proceedings that require urgent court action, although the normal court is out of session.
On Friday morning, CJI Surya Kant had stated that he was willing to sit on the first day of the winter vacation (December 22). As submissions were being made over the listing of urgent cases, the Chief Justice stated that the court registry would critically evaluate the urgency of the cases and only include in the list those that are indeed urgent.
“We will sit on Monday. We shall not add to the already long workload of other Supreme Court judges who are already forced to study files late into the night so as to have time to listen to new cases. I shall not bother any other bench, said the Chief Justice in open court.
He also said that the number of benches that would be available during the vacation would depend on the number of urgent cases received.
