The case was filed on Monday by police in Kerala in the Kasaragod district against the organisers of a music concert that had to be stopped after the audience became so crowded that they panicked and felt uneasy, the officials said. The event was the concert of the popular Malayalam singer Hanan Shaah, during an expo at one of the grounds adjacent to the private bus stand on Sunday evening.
The officials claimed that the venue was filled to dangerous levels and the scenes were chaotic as many spectators could not breathe and stand straight because of the excessive crowding. Some 16 individuals were taken to a hospital with complaints of difficulty breathing and feeling dizzy. The circumstances intensified and the police intervened and halted the concert in the middle and forcibly dispersed the crowd after several of the attendees ignored their calls to move out of the venue.
This has already led to the registration of a case against various organisers, among whom are Shahzaman Thottan, Nawalu Rahiman, Haris Aboobeckar, Khalid ED, Jubair, and other recognisable members of the organising committee of the event. The organisers had permission with the organisers saying that the crowd was not going to be more than 5,000 people, but the attendance and mismanagement was way over the safe capacity of the venue and security arrangements that the venue could hold.
The case is submitted under various provisions of the Bharatiya Nyaya Sanhita (BNS) such as the provision of and 125 (endangering human life), and 125(a) (endangering personal safety causing hurt), 189(3) (unlawful assembly) and 3(5) (joint criminal liability). Moreover, it has been charged upon Section 118(e) of Kerala Police Act that relates to the knowledgeable commission of an act that endangers others.
The event has raised concerns regarding crowdsafety and the organisation of the events in the open gatherings, which led to the efforts by the authorities to monitor them more strictly and establish more precise guidelines regarding the future events.
